This course introduces students to the law governing the intergenerational transfer of wealth. Applying case law, the Uniform Probate Code (“UPC”), the Uniform Trust Code (“UTC”), and Tennessee law, the course covers the probate process and surveys the law of intestacy, wills, will substitutes, trusts, and the duties and powers of trustees in trust administration. This course will also build upon the knowledge students received in Property I, including the law of future interests and the Rule Against Perpetuities. At every point, the course will emphasize the ethical challenges inherent in the practice of this body of law.
